The following is a brief description of your options after you receive a civil traffic complaint and the steps involved in the various court processes.

Your traffic complaint has a check box to the right of the violation description. If the check box to the right of the violation description is checked CIVIL TRAFFIC you may choose one of four options or may appear on or before the date and time shown on your civil traffic complaint to resolve your case. If you have multiple violations on your civil traffic complaint, you will need to indicate your choice for each violation.

FAILURE TO COMPLY BY THE APPEARANCE DATE (lower portion of complaint) WILL RESULT IN ADDITIONAL MONETARY PENALTIES AND DRIVER LICENSE SUSPENSION.

If you wish to comply by coming to court in person before the appearance date, ALLOW AT LEAST 10 WORKING DAYS after the day you were issued the ARIZONA TRAFFIC TICKET AND COMPLAINT for the complaint to be processed.

NO CONTINUANCES FOR APPEARANCE IN COURT WILL BE GRANTED BY TELEPHONE ON CRIMINAL MATTERS.

DEFENSIVE DRIVING SCHOOL

You are not eligible for the Defensive Driving Program if you have a Commercial Driver License UNLESS you were driving a vehicle requiring a Class D license or a Class M license and the vehicle was not being used for commercial purposes.

If you received more than one charge on your Complaint, the Defensive Driving program option is available for only ONE of the eligible minor traffic charges. All other violations must be taken care of with the court on or before your appearance date.

YOU MAY BE ELIGIBLE FOR DEFENSIVE DRIVING SCHOOL IF:

You have not attended a defensive driving class in Arizona within the last 12 months (violation date to violation date).
Your traffic charge did not result from an accident involving serious physical injury or fatality.
The complaint has not already been set for a hearing or trial.
Your violation must be on the list of eligible violations. Click here to view the list .

VIOLATIONS NOT ELIGIBLE FOR DEFENSIVE DRIVING PROGRAM:

Pedestrian Violations
Registration and Driver License Violations
Seat Belt Violations
Child Passenger Restraint
Use of Portable Communication Device (Cellular Telephone)

IF YOU RESIDE IN A DIFFERENT STATE, YOU MUST COMPLETE A STATE OF ARIZONA PROGRAM THROUGH AN ARIZONA CERTIFIED DEFENSIVE DRIVING SCHOOL. IF YOU TAKE A CLASS ONLINE, YOU MUST COMPLETE THE STATE OF ARIZONA PROGRAM REGARDLESS OF WHAT STATE YOU ARE IN. THE COST TO ATTEND MAY VARY AMONG THE SCHOOLS. THE COURT MAY GRANT A ONE TIME 30-DAY EXTENSION TO ATTEND DEFFENSIVE DRIVING SCHOOL. FAILURE TO COMPLETE THE DEFENSIVE DRIVING CLASS MAY RESULT IN THE ENTRY OF A DEFAULT JUDGEMENT, AND/OR YOUR DRIVER LICENSE SUSPENSION, AND ADDITIONAL MONETARY PENALTIES.

CONTEST THE COMPLAINT

Please come to the court to request a civil traffic hearing. You may request a civil traffic hearing by mail by following the instructions on the Request a Documentary Hearing option. The hearing will not be held on your original appearance date.

You must appear on the scheduled date and time and be ready to present evidence and examine witnesses in front of a Judge or Hearing Officer. At your hearing, you may bring witnesses and you will have the opportunity to present your case before a judge. Once the hearing is held and if at the conclusion of your hearing you are found responsible, you can NO longer attend Defensive Driving School and you are responsible for paying any fine that is imposed.

FAILURE TO APPEAR MAY RESULT IN THE ISSUANCE OF A DEFAULT JUDGMENT AND DRIVER LICENSE SUSPENSION WITH ADDITIONAL MONETARY PENALTIES BEING IMPOSED.

Waive your right to a hearing, enter a plea of responsible and pay the fine. You do not have to appear in court. Payment must be received by the court prior to your court date. We suggest allowing at least 5 days for mailed payments.

Acceptable forms of payment are: CASH, CREDIT/DEBIT CARDS, MONEY ORDERS, PERSONAL CHECKS, OR CASHIER'S CHECKS. Payments can be made on-line, by mail or in person.

To make cash payments on your fines you can use the PayNearMe service available at select merchants or visit the front counter at the court during regular business hours and we will provide you with the information required to make offsite cash payments. An additional service fee will apply.

The court does NOT accept personal checks if you are past due. A $50.00 charge will be assessed on all checks that are returned for non-sufficient funds.

Please note: It is the defendant's responsibility to follow up with the court to ensure that the payment or correspondence sent by mail was received by the court and that all charges have been resolved on or before the court date on your citation.
